UPHOLDING

Justice McEwan's judgment in the Bacon case is a must read for those of us concerned about the direction in which the federal government is taking Canadian corrections. In A Flawed Compass Graham Stewart and I criticized the Conservative government's "Roadmap" and "Transformation" Aggenda for its total disregard of international legal standards, relevat judgments of Canadian courts, including the Supreme Court of Canada, the evidence and literature of research and the history of abuse when human rights are subordinated to administrative convenience and the discretion of correctional administrators. In sharp relief to the "Roadmap" Justice McEwen charts the necessary legal pathway to the analysis of the conditions of confinement in Canadian prisons that places at the forefront, not the periphery, respect for human rights
